Selective Insurance Company of America CCPA Employee Privacy Notice

Effective Date: January 1, 2023

Selective Insurance Company of America ("Selective," "we," "us," or "our") provides this Privacy Notice to job applicants, employees, and contractors residing in the State of California who are considered "Consumers" under the California Consumer Privacy Act of 2018 ("CCPA") and from whom we collect "Personal Information" as described in the CCPA. For purposes of this CCPA Employee Privacy Notice, when we refer to Consumers, we mean you to the extent you are a California job applicant, employee, or contractor. This CCPA Employee Privacy Notice sets forth privacy practices applicable to Consumers.

Information We Collect

We may collect Personal Information from you in various situations, including, but not limited to, on our website, your mobile device, through email, in physical locations, through the mail, and/or over the telephone. In the preceding 12 months, Selective collected the following categories of Personal Information from California Consumers, depending on the particular Business Purpose (described in the How We Use Personal Information section below):

A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver's license number, or passport number.

Categories of information described in Section 1798.80(e) of the California Civil Code

A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, medical information, or health insurance information.

Characteristics of protected classifications under California or federal law

Age, race, color, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth, and related medical conditions), sexual orientation for same-sex benefits, veteran or military status.

Commercial or transactions information

None.

Biometric information

None.

Internet or other electronic network activity information

Browsing history, search history, and information on a consumer's interaction with a website or application.

Geolocation information

Physical location.

Sensory information

None.

Professional or employment-related information

Current or past job history or performance evaluations.

Education information

Information about an employee's educational background, such as education records, report cards, and transcripts that is not publicly available.

Inferences drawn from the above information

Profile reflecting a person's preferences, characteristics, predispositions, behavior, attitudes, or abilities.

Other information about you that is linked to the Personal Information above

 

Personal information does not include de-identified or aggregated Consumer information.

Some of the information described above is also "Sensitive Personal Information," as defined under the CCPA. We do not use or disclose Sensitive Personal Information for purposes other than those specified in the CCPA. 

Selective obtains the categories of Personal Information listed above from the following categories of sources:

  • Directly from you. For example, from forms you complete or services we provide you.
  • Indirectly from you. For example, from observing your actions on our website or from information your computer or mobile device transmits when interacting with our website or mobile applications, among other things.
  • Third parties, including recruiters who submit your information to us for an employment position that may interest you, references you provide, and consumer reporting agencies for employment background checks. 
  • Combination of sources. We collect Personal Information about our employees and other individuals' emergency contacts and beneficiaries from such employees or other individuals.
 

How We Use Personal Information

Selective collects the Personal Information identified above for the commercial and Business Purposes listed below, without limitation:

  • To recruit employees, including conducting employment-related background screening and checks.
  • To administer benefits, such as medical, dental, optical, commuter, and retirement benefits, including recording and processing eligibility of dependents, absence and leave monitoring, insurance and accident management, and provision of online total reward information and statements.
  • To pay and reimburse for expenses, including salary administration, payroll management, payment of expenses, to administer other compensation-related payments, including assigning amounts of bonus payments to individuals, administration of departmental bonus pools, and administration of stock option payments.
  • To conduct performance-related reviews, including performance appraisals, career planning, skills monitoring, job moves, promotions, and staff restructuring.
  • To monitor work-related licenses and credentials, including provisioning software licenses for use in the course of an employee's work-related responsibilities and ensuring compliance, training, examination, and other requirements are met with applicable regulatory bodies.
  • To provide our employees with human resources management services, including providing employee data maintenance and support services, administration of separation of employment, approvals and authorization procedures, administration and handling of employee claims, and travel administration.
  • To maintain your contact information.
  • To assist you in case of emergency, including maintenance of contact details for you and your dependents in case of personal or business emergency.
  • To monitor eligibility to work in the U.S., meaning monitoring and ensuring compliance of employees' ability to work in the U.S.
  • To conduct healthcare-related services, including conducting pre-employment and employment-related medical screenings for return-to-work processes and medical case management needs; determining medical suitability for particular tasks; identifying health needs of employees to plan and provide appropriate services, including operation of sickness policies and procedures; and providing guidance on fitness for travel and fitness for expatriation.
  • To facilitate a better working environment, which includes conducting staff surveys, providing senior management information about other employees, and conducting training.
  • To help ensure a safe and efficient working environment, which includes activity relating to disciplinary actions and code of conduct processes and investigations.
  • To maintain security on Selective websites and internet-connected assets, which includes hosting and maintenance of computer systems and infrastructure; management of Selective's software and hardware computer assets; systems testing, such as the development of new systems and end-user testing of computer systems; training; and monitoring email and Internet access.
  • To comply with applicable law or regulatory requirements, such as legal (state and federal) and internal company reporting obligations, including headcount, management information, demographic, and health, safety, security, and environmental reporting.

 

How We Share Personal Information

Selective may disclose your Personal Information to a third party, including to our service providers, for any commercial or Business Purpose listed above. We do not sell the Personal Information we collect about Consumers or share such information for targeted advertising purposes.  
We disclose and share your Personal Information with the following categories of third parties:

  • Service providers
  • Third parties with whom you direct us to share your Personal Information
  • Third parties as part of our employment process, such as consumer reporting agencies for employment background checks
  • Government entities
  • Operating systems and platforms

 

How Long We Retain Personal Information

The Personal Information we collect about you is stored by Selective or by our Service Providers on our behalf. We retain Personal Information we collect for as long as we need to use it in connection with our business. When Selective no longer needs the Personal Information, we will de-identify, aggregate, or delete this information where required by law.  

Your Rights Regarding Personal Information

California residents have certain rights concerning the Personal Information collected by businesses. If you are a California resident, you may exercise the following rights regarding your Personal Information, subject to certain exceptions and limitations:

  • The right to know the categories and specific pieces of Personal Information we collect, use, and disclose about you, the categories of sources from which we collected Personal Information about you, our purposes for collecting Personal Information about you, the categories of Personal Information about you that we have disclosed for a Business Purpose, and the categories of third parties with which we have shared Personal Information.
  • The right to request that we delete the Personal Information we have collected from you.
  • The right to request correction of inaccurate Personal Information we maintain about you. The right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA.

Verification Process And Required Information

Note that we may need to request additional information from you to verify your identity and understand the scope of your request, although you will not be required to create an account with us to submit a request or have it fulfilled. We will require you to provide, at a minimum, your name, and email address.

Authorized Agent

You may designate an authorized agent to make a CCPA request on your behalf. If so, you must provide the authorized agent written permission to do so. We may require that you verify your identity directly with us, and we may require other proof of the agent's authority to act on your behalf.

Changes To Our CCPA Employee Privacy Notice

Selective reserves the right to amend this privacy notice at our discretion and at any time. When we make changes to this Privacy Notice, we will post the updated notice and update the notice's Effective Date above.

Your Rights As A Consumer

We may collect information about you unrelated to your role as an applicant, employee, or contractor if you are a consumer of our services. More information about our privacy practices and your rights as a consumer under state privacy laws can be found in our Privacy Notice.
